    Millions of disgruntled concertgoers likely to sue Ticketmaster

    LOS ANGELES (CN) — Millions of people who bought concert tickets through Ticketmaster are inching closer to proceeding as a class on claims that Live Nation Entertainment and its Ticketmaster subsidiary used their monopoly power to inflate ticket prices.

    U.S. District Judge George Wu took the consumer’s motion for class certification under submission at a hearing Thursday in Los Angeles federal court.

    Although the judge’s tentative decision wasn’t made publicly available, the tenor of the arguments before him indicated that he was likely to grant the motion.

    To be able to proceed as a class will give the plaintiffs more leverage to try to negotiate a significant settlement because Live Nation could potentially face billions of dollars in damages if the case goes before a jury. Under federal antitrust law, plaintiffs are entitled to treble their actual damages if they prevail.

    The consumer lawsuit, initiated in January 2022, seeks monetary compensation on behalf of a vast number of ticket buyers, both original and resale. The plaintiffs argue that Live Nation and Ticketmaster have established a dominant position within the ticketing market, which has led to inflated prices for consumers. The court previously acknowledged that the allegations of monopolistic practices hold merit, with the plaintiffs specifically asserting that Ticketmaster commands approximately 60% of a particular submarket within the industry.

    Judge signals he’ll let Ticketmaster customers proceed as class in Live Nation antitrust lawsuit

    A federal judge in California signaled he’s likely to allow millions of Ticketmaster customers to proceed as a class in an antitrust lawsuit accusing Live Nation Entertainment and its subsidiary of using monopoly power to boost ticket prices.

    US District Judge George Wu took the motion for class certification under submission on Thursday (December 4) following a hearing.

    Plaintiffs led by Skot Heckman, a Ticketmaster customer, sued the ticketing giant in January 2022 for allegedly engaging in secondary ticketing market manipulation, anti-competitive practices and consumer harm.

    In the 2022 lawsuit, which you can read here, Live Nation and Ticketmaster were accused of secretly providing primary tickets to brokers through “ticket banks,” while publicly claiming to fight scalpers.
