‘It’s clearly the windscreen wiper’: Ex-lawyer fights seatbelt fine

Exclusive: Angry NSW motorists are fighting a flood of AI seatbelt fines, claiming blurry and indecipherable camera photos fail to prove any wrongdoing.

John, a former lawyer who asked for his surname to be withheld, claims his adult daughter was wrongly fined for wearing her seatbelt incorrectly while she was visiting Australia on a recent trip from England.

John believes the windscreen wiper in the photo provided by Revenue NSW may have been mistaken for a seatbelt. Supplied

It was a rainy weekend in June when his daughter was driving from Sydney to the Central Coast for a family birthday party.

Perth’s AI cameras catch out 81,000 drivers … then what?

WA’s controversial AI cameras have caught more than 81,000 motorists for suspected seatbelt offences — but hundreds of cases have since been dumped by police prosecutors.

The cameras have issued 81,412 seatbelt-related infringements since being introduced in WA, with about 5700 — 7 per cent — overturned through the Department of Transport review process.

WA Police have separately dismissed hundreds of cases after prosecutors decided there was “no reasonable prospect” of conviction.

The figures reveal the growing gap between what the AI technology detects and what can ultimately be proved in court.

The technology uses cameras to identify drivers and passengers who appear not to be properly restrained, with images then reviewed before infringements are issued.

Using a pillow in the car? New AI road cameras could fine you hundreds

Fines for not wearing seatbelts have surged by almost 700 per cent in one state while experts believe artificial intelligence (AI) technology is unfairly penalising some drivers.

New analysis from Compare the Market shows NSW seatbelt fines have soared by 690.2 per cent between 2023 and 2024, following the introduction of AI-powered cameras capable of detecting drivers not wearing their seatbelts correctly.

Tasmanian fines in the same period increased by 98 per cent and Victorian fines by 75 per cent.

National seatbelt fines rose from 85,768 in 2023 to 183,315 in 2024, an increase of 113.7 per cent in just one year.

It comes as Queensland has just updated its road rules to allow drivers to nominate adult passengers for camera-detected seatbelt offences, the first of any state or territory in Australia.
