Court rules against ANZ in class action lawsuit

ANZ has been unsuccessful in its fight in the High Court against a class action from borrowers.

The court has awarded summary judgment against the bank in relation to the Credit Contracts and Consumer Finance Act 2003 (CCCFA) class action proceedings.

Between 2015 and 2019, the law said that a lender that was in breach of its disclosure requirements had to repay borrowers all the interest and fees they were charged during the time when they were not compliant with the rules.

The class action claims that between 30 May, 2015 and 28 May, 2016, a coding error in one of ANZ's systems failed to take into account interest that had been accrued and not yet charged.

Next week's budget will feature changes to the capital gains tax, negative gearing and the taxation of trust funds.

Some of the details have been left undecided until the last minute.

All three featured in Labor's 2019 election platform, but the policy design will differ.

Negative gearing will be curbed, the capital gains tax (CGT) discount overhauled, and new tax rules imposed on trusts in next week's federal budget as the Albanese government braces for a fierce debate about housing, wealth and intergenerational fairness.

In his first term, Anthony Albanese was highly reluctant to break promises. He resisted for a long time recalibrating the Coalition’s tax cuts, because he had undertaken to deliver them intact.

Asked in one of the debates to confirm that “negative gearing is off the table”, the prime minister was unequivocal, “Yeah, it’s off the table […] the key is supply, and that measure will not boost supply”.

CGT change to tax existing investments based on length of ownership

The Albanese government plans to transition existing investors to a new capital gains tax regime through a hybrid grandfathering system based on how long an asset is owned.

Existing investors in property, shares and other assets will not be fully exempt from the CGT changes, with their future gains after the May 12 budget subject to the planned inflation indexation model, under a proposal Treasury has prepared for Treasurer Jim Chalmers.

The Parramatta Eels are deeply saddened by the passing of Chris Phelan (Eel #405), a member of the club’s 1982 and 1983 Premiership-winning teams.

Born in Ireland on December 12, 1955, Chris emigrated to Townsville in 1967 at age 12 under the “Ten Pound Pom” scheme. He began his rugby league journey with Estates in 1971, reaching A-Grade within two years.

He won a Townsville premiership with Souths in 1975 alongside his brother Paddy, later transitioning from wing to lock and earning Foley Shield Player of the Year honours in 1979.

A carpenter by trade, Chris built his strength and fitness through the physical demands of his work, carrying hardwood and heavy materials daily. After relocating to Brisbane, he further enhanced his conditioning, training with Greg Oliphant and tackling the torturous Mount Coot-tha runs in the height of summer.

Two-time Parramatta Eels premiership winner Chris Phelan has died at the age of 70 after a battle with pancreatic cancer.

A member of the club's back-to-back titles in 1982 and 1983, the Irish-born forward's passing was confirmed by the Eels on Tuesday afternoon.

Phelan played 53 games in the blue and gold jersey, while also representing Queensland on four occasions in the early-80s.

Tributes flow around NRL world after death of Eels champion and Origin player Chris Phelan

The NRL community is mourning the death of two-time Parramatta premiership winner and Queensland State of Origin player Chris Phelan. The Eels announced the sad news on Tuesday that Phelan passed away aged 70 after a battle with pancreatic cancer.

Born in Ireland, the tough as nails forward only played 53 games for Parramatta from 1982 to 1984, but helped the Eels win back-to-back premierships in 82 and 83 before playing another grand final in 84. He also played four State of Origin games for Queensland after emigrating to Townsville.

He won the 1981 premiership with Souths Magpies in the Queensland competition, and was awarded the Rothmans Medal for player of the season. He had a stint with Oldham in England from 1984 to 1985, and then won another premiership with Souths Magpies in 1985 alongside Queensland legends Mal Meninga and Gary Belcher, with Wayne Bennett as coach.

Universal has released a new trailer for Christopher Nolan‘s “The Odyssey.” The latest glimpse into the world of Homer’s Greek epic shows Matt Damon’s Odysseus doing battle with the Cyclops, as Robert Pattinson’s villainous Antinous tries to take the throne of Ithaca.

The trailer debuted first on Monday night’s episode of “The Late Show With Stephen Colbert.”

In addition to Damon as the titular seafaring hero, the film also stars Anne Hathaway as Odysseus’ wife, Penelope; Tom Holland as their son, Telemachus; Pattinson as Ithacan suitor, Antinous; Zendaya as goddess of wisdom, Athena; and Charlize Theron as goddess of witchcraft, Circe.
